USE OF ONLINE SERVICES
You agree that in using the Online Services, you will not:
(a) use parts of the Online Services reserved for registered members unless you are registered as a member;
(b) interfere with the use of the Online Services by others;
(c) use the Online Services in an illegal manner;
(d) upload, post, email or otherwise transmit any document or information to the Online Services that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, sexually, ethnically or otherwise objectionable or vilifying;
(e) upload, post, email or otherwise transmit any document or information to the Online Services that infringes any Intellectual Property Rights of any person;
(f) upload, post, email or otherwise transmit any computer or website programming code;
(g) attempt to circumvent any security features of the Online Services;
(h) upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
(i) interfere with or disrupt the Online Services, the server hosting the Online Services, or servers or networks connected to the server hosting the Online Services.
INTELLECTUAL PROPERTY RIGHTS
You acknowledge and agree that all information, images and materials on the Online Services, and all copyright and other intellectual property rights therein (Online Content) are owned by Grand Cinemas, its affiliates, suppliers or licensors unless expressly indicated otherwise. The Online Content is protected by Australian and international copyright and trademark laws.
You agree that you will not do any of the following without Grand Cinemas’ written permission:
(a) use Grand Cinemas trademarks, except for printing out a copy of the Online Services or personal use or as part of a reference to a Grand Cinemas product or service;
(b) reproduce, copy, modify, merge, adapt, translate, re publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Online Content available to the public;
(c) transmit or display the Online Content on any computer, system or network which permits electronic access by more than one user at a time;
(e) anything else which would infringe Grand Cinemas rights or the rights of Grand Cinemas content suppliers.
You may view the Online Content and use the Online Services so long as you don't change the form of copyright and other proprietary notices. If you are interested in a piece of content for your personal, non-commercial use, you may save a single copy, print one or download one.
You may be asked to provide Personal Information to Grand Cinemas before purchasing any movie ticket, goods or services from the Online Services, before entering any competition on the Online Services or before registering as a member of the Online Services. If you do not provide that Personal Information to Grand Cinemas, Grand Cinemas may not be able to sell you movie tickets, goods or services, enter you into competitions, provide you with additional benefits, or register you as a member.
(b) You acknowledge that if you do not register as a member of the Online Services, parts of the Online Services designed for registered members may not be accessible to you.
(c) You agree to keep all membership and registration information confidential and accept responsibility for all actions performed by any person accessing the Online Services using your member account.
(d) Grand Cinemas may use techniques designed to identify fraudulent activities on the Online Services, such as fraudulent credit card use. If any unauthorised use of your credit card occurs as a result of your credit card purchase on the Online Services, you should notify your credit card provider in accordance with its reporting rules and procedures.
(e) You agree that Grand Cinemas may cancel your registration as a member and/or refuse you access to the Online Services at any time in its sole discretion.
SUBMITTED DATA AND COMMENTS
For any information or material provided by you for entry into any competition hosted on the Online Services, or any comment made by you in respect to any information on the Online Services, you agree to grant Grand Cinemas the irrevocable, perpetual, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, sublicense, redistribute, adapt, transmit, publish, broadcast and display that information or material and create derivative works from it.
MOVIE TICKET PURCHASES
(a) Movie tickets purchased via the Online Services are (subject to paragraph (b)) non-refundable and are not available for exchange, unless required by applicable law or approved by Grand Cinemas’ executive management.
(b) Grand Cinemas reserves the right to refuse entry and may refund or exchange movie tickets for any movie session for which entry is refused if the tickets are presented for refund/exchange prior to the start of the movie session, including as a result of Grand Cinemas’ refusing your entry to a movie session. Evidence of payment must be presented in order for Grand Cinemas to consider refunding the price paid for any movie ticket. All refunds must in any event be returned to the same debit or credit card number or account that was used for the original sale, or alternatively in the form of Grand Cinema gift cards. Refunds will not be made in cash. No refunds or exchanges are available after the applicable movie session has started, including as a result of your ejection for a breach of the conditions of entry.
(c) A booking fee per ticket will apply to all tickets purchased via the Online Services, as set out in Grand Cinemas’ Schedule of Standard Charges.
(d) Where allocated seating applies to a session you may have the choice of choosing your own seat on the Online Services. Otherwise seat allocation for movie tickets purchased via the Online Services is on a "best available" basis and is carried out by a prescribed computer program.
(e) You agree that Grand Cinemas may at its discretion, refuse to sell movie tickets to you or withdraw any movie tickets from sale via the Online Services.
(f) The following conditions apply to each movie ticket purchased by you from Grand Cinemas:
• Printed ticket stub or electronic ticket must be retained as proof of purchase until you leave the cinema premises after viewing the applicable movie.
• A Show Spoilt pass will be issued to replace a ticket to a movie session cancelled or significantly interrupted due to circumstances beyond the control of Grand Cinemas (eg power failure). To receive a Show Spoilt pass, the printed ticket stub or electronic ticket must be presented immediately following cancellation of the movie session and before leaving the cinema premises.
• Proof of age may be requested for MA15+ and R18+ films. No Children under the age of 18 can be admitted into an R18+ movie under any circumstance. All children under the age of 15 must be accompanied by their parent or legal guardian for movies rated MA15+. If the above terms are not adhered to, Grand Cinemas reserves the right to refuse entry.For more information on Australian classifications please visit www.classification.gov.au
• Gold Lounge is a licensed venue. All persons under the age of 18 must be accompanied by their parent or legal guardian.
• Bags must be opened upon staff request.
• Cameras and audio visual recorders are not permitted in the auditoria.
• Only food and drink items purchased from Grand Cinemas Candy bar may be taken into the auditoria.
• Cans, glass bottles, hot food and alcohol are not permitted in standard auditoria unless with the prior written consent of Grand Cinemas.
• Footwear and neat casual dress is required in all auditoria.
• Putting your feet on the seat in front of you is prohibited.
• Inconsiderate behaviour, including talking or using electronic devices during the movie, is prohibited.
• Management reserves the right to refuse entry to, or eject you from, any movie session in its sole discretion, including as a result of your failure to meet any of applicable conditions of entry.
• Session times are subject to change without notice.
• Each auditorium of Grand Cinemas has specific rules and may have other conditions of entry that apply from time to time. These are made available at each auditorium and you agree to be bound by these.
PURCHASES AND GST
Prices on the Online Services include GST where applicable.
Payments made by you for the purchase of movie tickets, good or services on the Online Services are processed using Commonwealth Bank’s BPoint payment processing service. You agree to all terms and conditions applicable to your use of the BPoint payment processing service.
By entering any promotion or competition you are bound by and agree to comply with the competition terms and conditions of that competition.
MODIFICATION OF THESE TERMS AND THE ONLINE SERVICES
THIRD PARTY LINKS AND ADVERTISING
Grand Cinemas provides hyperlinks to third party sites (Linked Sites) for convenience only, and the inclusion of the hyperlink does not imply any endorsement of the Linked Site by Grand Cinemas or its affiliates. In addition, the inclusion of third party advertising on the Online Services (whether with or without hyperlinks) is not an endorsement or recommendation of the third party advertiser by Grand Cinemas or its affiliates.
You acknowledge and agree that Linked Sites are not under the control of Grand Cinemas and that Grand Cinemas is not liable or responsible for:
(a) any act, omission or negligence of any person who administers or owns any Linked Site;
(b) the copyright compliance, legality or decency of any Linked Site;
(c) the accuracy or reliability of any information provided by any Linked Site;
(d) any goods or services provided by any person who administers or owns any Linked Site; or
(e) the performance of any obligations owing to by any person who administers or owns any Linked Site
LIMITATION OF LIABILITY
(i) in the case of services, the resupply of the services or the cost of having services supplied again; and
(ii) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired.
(b) To the maximum extent permitted by law:
(i) neither party will be liable to the other party for any indirect, incidental or consequential loss or damage, or damages for loss of profits, goodwill, revenue, savings or opportunity arising under or in connection with this agreement or the use or supply of the Online Services;
(c) You acknowledge that, apart from where stated to the contrary within the Online Services, Grand Cinemas has not made any representations or given any warranties:
(i) as to the functionality or content of the Online Services;
(ii) as to the accuracy or completeness of any Online Content;
(iii) that access to the Online Services will be uninterrupted or error free or that the Online Services or the server which stores and transmits the Online Content to you are free from viruses;
(iv) that any links contained on the Online Services will provide you with any useful information; or
(v) that movie tickets to any particular cinema, movie or session will be available for sale to you.
You irrevocably submit to and accept the exclusive jurisdiction of any of the Courts of the State of Western Australia or the Commonwealth of Australia and any courts of appeal from these courts.
PLATFORM AND OS PROVIDER TERMS
Online Services which are mobile applications (Apps) are provided subject to the applicable store, platform or operating system provider’s terms, to the extent those terms are expressed to apply to an end-user’s use of Apps which operate with or are available through that store, platform or operating system. In particular:
In respect of Apps which you download through iTunes (iTunes Apps), you agree to the following:
(ii) Grand Cinemas grants you a non-transferable licence to use Grand Cinemas’ iTunes Apps on any Apple mobile device with which it is compatible, (such as iPhone, iPad or iPod touch, as applicable) and that you own or control. You must comply with the Usage Rules in the Apple Media Services Terms and Conditions, as they may exist from time to time.
You acknowledge that:
• Grand Cinemas (not Apple) is solely responsible for Grand Cinemas’ iTunes Apps and their contents; and
• Apple is not required to provide maintenance or support services for Grand Cinemas’ iTunes Apps.
Grand Cinemas, not Apple, is responsible for addressing any claims relating to the iTunes Apps or your possession and/or use of iTunes Apps, including, but not limited to: (i) product liability claims; (ii) any claim that iTunes Apps fail to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Apps accessible via Android devices include software from The Android Open Source Project Copyright (c) 2005-2008, The Android Open Source Project. Licensed under the Apache License, Version 2.0 (the “License”); you may not use this file except in compliance with the License. Unless required by applicable law or agreed to in writing, software distributed under the License is distributed on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied. See the License for the specific language governing permissions and limitations under the License.
The following terms and conditions in this section are applicable to all of Grand Cinemas’ available membership classes, as amended from time to time. Terms and conditions specific to particular membership classes are set out below under the relevant membership class. To the extent of any inconsistency, the terms and conditions specific to the relevant membership class prevails.
Memberships may be purchased from Grand Cinemas in accordance with Grand Cinemas Schedule of Standard Charges.
Membership holders who register with Grand Cinema’s Online Services will be entitled to receive additional benefits as specified in Grand Cinema’s Schedule of Additional Benefits and may receive further benefits such as special promotions available exclusively to the membership holder during the year.
Please note that any membership purchased at a reduced rate after 30 June in any membership year will not entitle the member to any benefits which expired on 30 June of that year.
Discounted movie tickets are not available with any other offer.
One membership per person per year. Membership is non-transferable and the card must be presented only by the member. Membership card must be physically presented to receive membership benefits as the card is required to access the record of benefits.
Grand Cinema may impose a “no free or discounted tickets” restriction to certain films and screenings at its discretion. This means that no special complimentary coupons, discounts or offers are valid for use on that specific film or screening until the restriction has been lifted. Restrictions are typically applied to special event screenings or premium cinema offerings.
Discounted tickets of a membership year are available for purchase (after your membership has been confirmed) from the 1st December of the preceding year through to 31st of December of the membership year. Membership expires on 31 December of the membership year. Provided that the card is registered, membership can be renewed each year using the same card by paying the membership fee applicable to the year of renewal. Renewals may be processed from 1 December each year for the following year.
Lost or stolen memberships can only be replaced if registered, and a charge is payable for each replacement in accordance with Grand Cinemas’ Schedule of Standard Charges. Identification must be provided with evidence of the full name and current address of the member in order to receive a replacement. Acceptable forms of identification are drivers licence or a bill received by post.
Memberships may be registered online at www.grandcinemas.com.au or by providing the required information to Grand Cinemas box office staff.
Membership cards remain at all times the property of Grand Cinemas.
Grand Cinemas reserves the right to change without notice the terms and conditions of the memberships, including the cost of movie tickets and the annual membership fee, provided that Grand Cinemas will not change any terms and conditions for an existing order that has been accepted by Grand Cinemas, the terms and conditions that will apply to the order are the terms and conditions that applied at the time you placed the order.
By purchasing and using your membership, you agree to the above stated terms and conditions.

The terms and conditions in this section are specific to the GrandCard membership.
GrandCard membership may be purchased from Grand Cinemas at any time. GrandCard membership entitles the cardholder to purchase:
(a) 2 super-discounted tickets valid in the period from 1 January to 30 June of the applicable year to any standard movie session in any standard auditoria, prices as specified in Grand Cinemas’ Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/Recliner Sessions);
(b) 2 super-discounted tickets valid in the period from 1 July to 31 December of the applicable year to any standard movie session in any standard auditoria, prices as specified in Grand Cinemas’Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/Recliner Sessions);
(c) Birthday Offer: 1 Standard admission, 1x Post- Mix Medium Drink, 1 Post Mix Drink for $20. Membership must have a valid birthday entered for the voucher to become available. Birthday Offer valid for the month of the the customers birthday which is saved on the membership. Offer can not be used for Special Event Sessions.
(d) Up to four discounted tickets per day to any standard movie session in any standard auditoria, prices as specified in Grand Cinemas’ Schedule of Standard Charges(surcharges may apply to 3D films and Grand CINEMAX/Recliner).
GrandCard membership holders who register with Grand Cinema’s Online Services will be entitled to receive additional benefits as specified in Schedule of Additional Benefits
By purchasing and using your GrandCard you agree to the above stated terms and conditions.
The terms and conditions in this section are specific to the Platinum membership.
Platinum membership may be purchased from Grand Cinemas at any time. Platinum membership entitles the cardholder to purchase:
(a) 2 super-discounted Gold Lounge tickets for any Gold Lounge session Monday to Thursday excluding special event screenings, prices as specified in Grand Cinemas Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/Recliner Sessions);
(b) 2 super-discounted tickets valid in the period from 1 January to 30 June of the applicable year to any standard movie session in any standard auditoria, prices as specified in Grand Cinemas’ Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/Recliner Sessions);
(c) 2 super-discounted tickets valid in the period from 1 July to 31 December of the applicable year to any standard movie session in any standard auditoria, prices as specified in Grand Cinemas’ Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/Recliner Sessions);
(d) Birthday Offer: 1 Gold Lounge Admission, 1x House Beer or Wine, 1 Dessert for $25. Membership must have a valid birthday entered for the voucher to become available. Birthday Offer valid for the month of the the customers birthday which is saved on the membership. Offer can not be used for Special Event Sessions. Please consult with bar staff on what dessert is available.
(e) up to 4 discounted tickets per day to any standard movie session in any standard auditoria and any CINEMAX/ Recliner session, prices as specified in Grand Cinemas’ Schedule of Standard Charges(surcharges may apply to 3D films); and
(f) up to 4 discounted Gold Lounge tickets per day for any Gold Lounge session on any Monday, Tuesday, Wednesday, Thursday and Sunday. Friday and Saturday before 5 pm (excluding public holidays and special event screenings), prices as specified in Grand Cinemas Schedule of Standard Charges (surcharges may apply to 3D films and Grand CINEMAX/ Recliner Sessions).
Platinum membership holders who register with Grand Cinema’s Online Services will be entitled to receive additional benefits as specified in Grand Cinema’s Schedule of Additional Benefits.
By purchasing and using your Platinum membership you agree to the above stated terms and conditions.
The terms and conditions in this section are specific to the Silver Screen membership.
Grand Cinemas Silver Screen membership is available for purchase by all Senior Citizens 60 years and older. The member must present a valid WA seniors card each time they attend the cinema if requested by staff of Grand Cinemas. Australian National Seniors card will not be accepted.
Silver Screen Membership entitles the cardholder to a discounted price admission ticket as specified in Grand Cinemas’ Schedule of Standard Charges in respect of the applicable membership year to any standard movie session in any standard auditoria, any day. A surcharge is applicable to all 3D screenings and Grand CINEMAX/ Recliner sessions. The cardholder may view more than one film a day, however the discount is only applicable once on a specific film a day.
Silver Screen Membership also entitles the cardholder to one voucher for a FREE Coffee/Tea. Present your current Silver Screen membership card and voucher at the Candy Bar to receive a single standard Coffee/Tea for free.
Silver Screen members who register with Grand Cinema’s Online Services will be entitled to receive additional benefits as specified in Grand Cinemas’ Schedule of Charges
By purchasing and using your Grand Cinemas Silver Screen membership card you agree to the above stated terms and conditions.
The terms and conditions in this section are specific to the Kids Club membership.
Grand Cinemas Kids Club membership is available to purchase by or on behalf of all persons aged between 3-17 years. School identification may be required as proof of age upon purchase or use of Kids Club membership card.
Discounted Kids Club movie tickets are valid for the purchase of G, PG, M & MA15+ classified films only. Membership entitles the cardholder to a discounted movie ticket as specified in Grand Cinemas’ Schedule of Standard Charges to any standard movie (subject to the above limitation) in any standard auditorium, any day. A surcharge may apply to 3D and Grand CINEMAX/Recliner screenings. The cardholder may view more than one film a day however the discount is only applicable once on a specific film a day.
Grand Cinemas Kids Club membership entitles a cardholder to receive:
(a) 2 super-discounted tickets to any standard movie session in any standard auditoria valid in the period from 1 January to 30 June of the applicable membership year, prices as specified in Grand Cinemas’Schedule of Standard Charges, and
(b) 2 super-discounted tickets to any standard movie session in any standard auditoria valid in the period from 1 July to 31 December of the applicable membership year, prices as specified in Grand Cinemas’ Schedule of Standard Charges.
Kids Club membership also entitles the member to Special Candy Bar offers, as published and made available by Grand Cinemas from time to time. All vouchers and discounts may be subject to additional terms and conditions.
By purchasing and using your Grand Cinemas Kids Club membership card you agree to the above stated terms and conditions.
Grand Cinemas is a proud affiliate of the Companion Card (operated by Companion Card WA – www.wa.companioncard.org.au).
Companion Cardholders may obtain a Companion Ticket for any standard movie session in any standard auditorium for their Carer subject to the usual conditions for entry (see Movie Ticket Purchases section above). This offer is not available for Gold Lounge cinemas, Cinemax/Recliner cinemas, special screenings or events. Note: Grand Cinemas will ask you to provide a ‘gold coin’ donation for charitable purposes.
Companion Tickets are only available for purchase at the box office at each Grand Cinema location, subject to presentation of the Companion Card and the purchase of an appropriate ticket for the Companion Cardholder.
This policy applies to purchases of Gift Vouchers, Movie Money books and associated products (other than movie tickets) (“Gift Products”) via the Online Services.
All sales of Gift Products are considered final and returns, exchanges or refunds are not generally available, with the following limited exceptions;
(a) Where required by law under the Competition and Consumer Act 2010 or other relevant legislation. For example:
(i) Where a product is faulty; or
(ii) Where a product is not as described or the incorrect product has been delivered.
(b) Grand Cinemas may, at its sole discretion, offer a refund or exchange in selected cases that are beyond the requirements of legislation. However it is under no obligation to do so and this provision should not be relied upon when making a purchase decision.
Any refunds or exchanges made under this provision will require a copy of your tax invoice (email receipt) as proof of purchase.
Where a refund or exchange is offered, it is a condition of the refund or exchange that the applicable Gift Product be returned to Grand Cinemas
(c) Gift Products which are vouchers are to be treated as cash, and will not be replaced or refunded if lost, stolen or damaged. Vouchers are not redeemable for cash. Vouchers are not rechargeable and are valid for 2 years from the date of issue.
In all cases, consideration for an exchange or refund will only be given if the Gift Products have not been redeemed. All items comprising the applicable Gift Product including any bonus items or gift packaging must be returned or a refund/exchange will not be available.
REQUESTING A RETURN, REFUND OR EXCHANGE OF GIFT PRODUCTS
To request a return, refund or exchange, please contact Grand Cinemas via the contact form on Grand Cinemas’ Online Services or email.
If contacting Grand Cinemas via email or Grand Cinemas’ contact form, please ensure you provide the following information:
(a) Your full name
(b) Your contact information including phone number
(c) The product you purchased
(d) The date of your order
(e) Your order number (provided on your tax receipt)
(f) Details of your request
(g) Reason for your request
Grand Cinemas will endeavour to contact you within 2 working days to discuss your request.
REFUNDS ON CREDIT OR DEBIT CARD TRANSACTIONS MUST BE RETURNED TO THE SAME CARD NUMBER OR ACCOUNT USED FOR THE ORIGINAL SALE.
DELIVERY OF GIFT PRODUCTS
This section applies to the delivery of Gift Products from the Online Services.
Grand Cinemas will endeavour to ensure that Gift Products are dispatched within 3 business days following the day of your order.
While every attempt is made to keep all Gift Products offered on the Online Services in stock at all times, on rare occasions one or more Gift Products may be temporarily out of stock. Should this occur, the customer will be contacted and alternative arrangements discussed. This may include, at the customer preference, a refund, alternative product being supplied, or waiting until the product is in stock.
All Gift Products are dispatched via Australia Post Express Post and are delivered subject to Australia Post’s standard delivery terms and estimates. A delivery charge per order applies in addition to the purchase price of the Gift Product as per Grand Cinemas’ Schedule of Standard Charges.
